1. Supreme Court sides with S. Chuluun, prompting a debate about SLAPP suits
The Supreme Court of Mongolia upheld an appeal by S. Chuluun, director of the Chinggis Khaan National Museum, in his defamation suit against G. Munkh-Erdene, a lecturer at the National University of Mongolia, iSee.mn and Ergelt.mn reported. The first-instance and appeal courts had dismissed the suit, finding that Munkh-Erdene's Facebook posts were a researcher's criticism. The Supreme Court amended those rulings, saying the lower courts had no grounds to treat the posts as criticism because the defendant had not proved with evidence in the case file that the information was accurate. Users on X criticised the ruling as a possible precedent for SLAPP suits (strategic lawsuits against public participation), in which officials use the courts against their critics. The most widely shared post noted that the case had dragged through the courts for two years.
