The full bench of the Supreme Court's criminal chamber on Wednesday (October 28) declined to hear on supervisory review the case of Z. Enkhbold, former head of the President's Office, and former MP B. Enkh-Amgalan. The appeal court's sentence of a ₮40 million fine for each of them therefore stands.

The ruling

According to Graph.mn, the bench considered complaints filed by B. Enkh-Amgalan's lawyer and by Z. Enkhbold and his lawyers. The lower courts had found B. Enkh-Amgalan guilty, as a principal, of abusing his position over a continuing period while a politically exposed person to create an unfair advantage for others, and Z. Enkhbold guilty of unlawfully influencing him and instigating that offence.

The Supreme Court found that the complaints did not meet the grounds for supervisory review set out in Article 40.1, paragraph 1 of the Criminal Procedure Law.

How the case unfolded

According to iSee.mn, the first-instance court had sentenced both men to two years in prison and barred them from public office for five years. On their appeal, the appeal court replaced the prison terms with fines of ₮40 million each. In connection with the case, B. Enkh-Amgalan spent 243 days in pre-trial detention and Z. Enkhbold 74 days.
